COMMERCIAL GENERAL
LIABILITY
Commercial General Liability (CGL) is liability coverage for
your business. CGL does not cover personal liability. This type
of coverage generally can be written for almost any type of
business. Exceptions are auto dealers and
repair shops, which have their own
special type of Liability coverage known as Garage
Liability.
Coverage A on a CGL is a bodily injury (BI) and property
damage (PD) coverage that will pay for your legal
liability to others resulting
from negligence.
CGL coverage is also provided for any liability resulting
from the negligent by your employees. However,
injury to your own employees is not covered (that would fall
under your workers compensation coverage).
A Commercial General Liability policy will usually
pay the cost of hiring a lawyer, in
addition to your policy limits.
Operations Liability
Liability coverage for businesses that do not have a single
fixed premise but, various premises.
Mobile Equipment
Liability
Liability or damage done by mobile equipment (construction
equipment) is also covered as long as the mobile equipment is
being used off the public roads.
Products and Completed Operations
Liability
Coverage designed for businesses that manufacturer products,
sell products, or build products.
Contractual Liability or Assumed
Liability
Liability coverage for a signed agreement (contract) and the
insured is assuming all liability.
Owners and Contractors Protective
Liability
Covers general contractors that are assumed
responsible for the acts of any subcontractors they may
hire.
Coverage A on a Commercial General Liability
policy has many exclusions, including no
coverage for:
- Expected and intentional acts
- Liquor liability
- Any obligation of the insured under Workers’
Compensation laws
- Any liability related to pollution
- Any liability arising out of the ownership, use,
loading, or unloading of any aircraft, auto, or
watercraft.
- Fire damage to property the insured owns, rents, or
occupies
- Damage to personal property in the insured’s care,
custody, or control.
Coverage B in Commercial General Liability
provides coverage for Personal and
Advertising Injury Liability. This type of
liability covers financial damages due to oral or written
publication of materials that slanders or
libels a person or disparages a person’s goods,
products, or services, or oral or written publication of
material that violates a person’s right of
privacy.
Coverage C on a CGL is a no fault
coverage called medical. The purpose of this coverage
is to prevent lawsuits. It only applies to others, not to the
insured or employees.
Supplementary payments in addition to
limits
The insurer (insurance company) agrees to pay, with respect
to any claim or lawsuit it defends under Coverage A or B, all
expenses it incurs, all reasonable expenses incurred by the
insured (you) at the insurer’s request, including earnings up
to $250 a day, cost of bail bonds, and bonds to release
attachments, and any interest that accrues after entry of a
judgment but before the insurer pays the claim. Supplementary
payments do not reduce the limits of insurance and are paid in
addition to the applicable limits of liability.
